TERMS & CONDITIONS

Letango Tours  |  Cross Border Ventures LLC

Effective for all bookings made through letango.com

The purchase of any travel service offered by Letango Tours constitutes a contractual arrangement between you (the "Traveler") and Cross Border Ventures LLC, doing business as Letango Tours ("Letango Tours," "we," or "us"), and represents your full acceptance of these Terms & Conditions. Please read them carefully prior to booking.

1. BOOKING & CONFIRMATION

Our website is designed to answer many of your questions upon first contact. When you register and submit a booking form, you will receive an order confirmation. We reserve the right to cancel this order within 48 hours if we determine it cannot be fulfilled—for example, due to a last-minute request or a date affected by local holidays that prevent adequate planning. In such cases, you will be notified promptly and receive a full refund.

Services may be reserved by phone or through our online booking system. Please note that Letango Tours cannot hold or confirm services until payment has been received.

2. PAYMENT TERMS

Deposit: A deposit is required at the time of booking to secure your reservation. We accept Visa, Mastercard, and American Express. All credit card transactions are processed securely through Stripe.

Credit card surcharge: A 3% processing fee applies to all credit and debit card payments. No surcharge applies to ACH bank transfers.

Balance: The remaining balance is due by ACH transfer or credit card no later than 30 days prior to the commencement of services. Please ensure billing information matches the card on record with your bank. We cannot guarantee services unless payment has been completed in full.

Confirmation: Once payment is processed, you will receive a confirmation email. Payments will appear on your bank statement as "Letango Tours."

3. CANCELLATIONS & REFUNDS

Cancellation policies vary depending on the type of service booked. Two separate policies apply:

A) Day Tours (guide, entrance fees, local transport):

•  More than 7 days before the tour: full refund, less any non-refundable entrance tickets already purchased.

•  3–7 days before: 50% refund, less non-refundable tickets.

•  Less than 72 hours / no-show: no refund.

B) Multi-Day Packages (itineraries including hotels, transport, guides, and/or activities):

•  More than 45 days before departure: 20% of total booking value, to cover itinerary design, research, reservations, and coordination costs already incurred. Balance refunded.

•  30–45 days before departure: 35% of total booking value.

•  15–29 days before departure: 50% of total booking value.

•  Less than 15 days / no-show: 100% of total booking value. No refund.

Note: Custom or peak-season itineraries may carry stricter terms due to non-recoverable supplier commitments. Any such exceptions will be clearly stated in your quote and take precedence over the above schedule. All cancellation requests must be submitted in writing to tours@letango.com.

Letango Tours reserves the right to cancel any service due to insufficient participants, safety concerns, or Force Majeure. In such cases, a full refund of amounts paid will be issued. Letango Tours is not responsible for incidental costs such as non-refundable flights or accommodation.

4. TRAVELER RESPONSIBILITIES

Traveler is responsible for arriving at the designated meeting point on time. The guide or driver is reserved for the specific time slot requested and is not obligated to extend the tour duration due to a late start, nor to postpone the tour. Letango Tours will make reasonable efforts to accommodate late arrivals but cannot guarantee that the guide is available beyond the originally scheduled time.

Traveler is responsible for carefully reviewing all vouchers, transfer details, activity confirmations, and guide information—including meeting times and locations—provided by Letango Tours. Please contact your guide or service provider directly in case of emergency or last-minute changes. Letango Tours office hours are Monday through Friday, 9:00 AM to 6:00 PM CET/CEST (Madrid time). Emergency contact details are provided in your travel documents.

Our tours involve walking and sightseeing. While day tours generally do not exceed 3 miles of walking, Travelers should be prepared to navigate hills, steps, and uneven cobblestone streets. Comfortable, supportive footwear is strongly recommended. Travelers should bring appropriate weather gear regardless of forecasted conditions.

5. LETANGO TOURS’ RESPONSIBILITIES

Letango Tours accepts responsibility for ensuring that all services described and included in your confirmed itinerary are delivered as stated by our service providers. We curate our network of guides, drivers, and local operators with care, and all licensed tour guides have passed official examinations to enter museums and monuments.

Letango Tours acts as an independent ground coordinator and travel organizer. Many services are delivered by independent third-party providers, including local guides, transportation companies, hotels, and activity operators. While Letango Tours selects these providers carefully, they operate independently and are not employees or agents of Letango Tours or Cross Border Ventures LLC.

6. INDEPENDENT CONTRACTOR STATUS

All European transportation vendors, local guides, accommodation providers, and other third-party suppliers utilized by Letango Tours are independent contractors. They are not employees, agents, or representatives of Letango Tours or Cross Border Ventures LLC. Letango Tours shall not be liable for the independent acts, errors, omissions, or negligence of these third-party service providers.

7. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL CUMULATIVE LIABILITY OF LETANGO TOURS AND CROSS BORDER VENTURES LLC TO ANY TRAVELER ARISING OUT OF OR RELATED TO SERVICES PROVIDED—WHETHER IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE—SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY THE TRAVELER FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.

LETANGO TOURS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF ENJOYMENT, TRIP INTERRUPTION COSTS, MISSED CONNECTIONS, OR OTHER EXPENSES ARISING FROM CIRCUMSTANCES BEYOND OUR DIRECT CONTROL.

Nothing in this clause limits Letango Tours’ liability for death or personal injury caused by its own proven gross negligence or willful misconduct. Travelers are strongly encouraged to purchase comprehensive travel insurance covering cancellation, medical emergencies, trip interruption, and baggage loss.

8. FORCE MAJEURE

Letango Tours cannot accept liability or pay compensation where the performance of our contractual obligations is prevented or materially affected by events beyond our reasonable control (each, a “Force Majeure Event”). Such events include, but are not limited to: acts of God; natural disasters; severe or unusual weather conditions; epidemics, pandemics, or public health emergencies; acts of war, terrorism, or civil unrest; government actions including travel bans or border closures; industrial disputes or strikes affecting transport networks; or any other extraordinary event that could not have been foreseen or avoided with all due care.

In the event of a Force Majeure Event, Letango Tours will use commercially reasonable efforts to arrange alternative services of comparable standard. Where this is not possible, Letango Tours’ liability will be limited to a pro-rated refund of fees paid for services not rendered, less any non-recoverable costs already committed to third-party suppliers. Letango Tours is not responsible for any additional accommodation, transportation, or other expenses incurred by the Traveler as a result of a Force Majeure Event.

Travelers are strongly advised to purchase comprehensive travel insurance that covers Force Majeure scenarios, including trip cancellation and interruption.

9. TRAVEL INSURANCE

Letango Tours strongly recommends that all Travelers purchase comprehensive travel insurance prior to departure. We are not responsible for costs that adequate insurance would have covered.

A suitable policy should cover at minimum: trip cancellation and interruption, emergency medical and dental expenses, emergency evacuation and repatriation, baggage loss or delay, and Force Majeure events including pandemics and government travel restrictions.

10. HEALTH & PHYSICAL REQUIREMENTS

Many of our tours involve moderate physical activity including extended walking, climbing stairs, and navigating uneven terrain. Travelers with mobility limitations, medical conditions, or other special requirements should contact us prior to booking so that we may assess whether the tour can be appropriately adapted. Letango Tours reserves the right to decline participation where a Traveler’s condition may pose a risk to themselves or others, or where required adaptations cannot be reasonably accommodated.

11. PERSONAL BELONGINGS & VALUABLES

Letango Tours and its service providers accept no responsibility for the loss, theft, or damage of personal belongings, luggage, or valuables during any tour or transfer. Travelers are responsible for the safekeeping of their personal property at all times. Travel insurance with baggage coverage is strongly recommended.

12. PHOTOGRAPHS & MEDIA

Letango Tours may occasionally take photographs or video during tours for promotional and marketing purposes. By participating in a tour, Travelers grant Letango Tours a non-exclusive, royalty-free license to use such images for marketing materials, website content, and social media, unless the Traveler explicitly opts out in writing prior to the tour. Letango Tours will not identify Travelers by name in any public-facing media without express written consent.

13. COMPLAINTS & DISPUTE RESOLUTION

If you experience a problem during your tour or service, please report it immediately to your guide, driver, or Letango Tours representative so that we may attempt to resolve it in real time. If your concern is not resolved to your satisfaction, please submit a written complaint to tours@letango.com within 30 days of the service date. Complaints submitted after this window may not be actionable.

Letango Tours will acknowledge your complaint within 5 business days and work in good faith toward a fair resolution.

14. GOVERNING LAW & JURISDICTION

These Terms & Conditions and all matters arising from the services provided by Letango Tours shall be governed by and construed in accordance with the laws of the State of South Dakota, USA, without regard to conflict of law principles. Any dispute, claim, or legal proceeding shall be brought exclusively before the state or federal courts located in Lawrence County, South Dakota. Both parties consent to the personal jurisdiction of such courts.

15. AMENDMENTS & SEVERABILITY

Letango Tours reserves the right to update or amend these Terms & Conditions at any time. The version in effect at the time of booking shall govern the applicable reservation. If any provision of these Terms is found to be unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

16. ACCEPTANCE OF TERMS

By making a booking, submitting a deposit, or making any payment to Letango Tours, the Traveler confirms that they have read, understood, and agree to be bound by these Terms & Conditions in their entirety.
